1. Definitions

1.1. For the purpose of these terms and conditions:



2. Terms of Service

2.1. These terms and conditions govern all contracts between CaterKing and the Customer, taking precedence over any other terms verbally agreed or implied by custom. The Company reserves the right to modify and update these terms at any time, with changes becoming effective upon being posted on the Company’s website.


3. Order Placement

3.1. Orders can be placed through CaterKing’s customer service team, Sales representatives, in-person at our office, or via our website. Placing an order implies acceptance of these terms and conditions.

3.2. All orders are subject to availability and current market conditions. If a product is unavailable, the Company may offer an alternative. If for any reason beyond our control we are not able to supply a particular product, CaterKing is not liable for any loss resulting from the unavailability of goods.

3.3. The Company reserves the right to limit the quantity of products supplied to any Customer and may decline to accept an order or close a Customer’s account without prior notice.

3.4. A binding contract is formed when CaterKing either accepts the Customer's order or delivers the Goods, whichever circumstance precedes.

3.5. Customers are responsible for ensuring that orders are successfully placed with the Company. CaterKing will not be liable for any order failures due to system errors or other issues.

3.6. A binding contract between the Customer and CaterKing is established once the Company either accepts the order or delivers the Goods to the Customer, whichever occurs first. For orders placed under specific advance order agreements, the contract is formed when CaterKing confirms the order and the Customer completes payment online by card.

3.7. Any typographical, clerical, or other errors or omissions in any of the Company’s documentation—such as sales literature, quotations, price lists, or invoices—may be corrected by CaterKing without any liability on the Company’s part.

3.8. CaterKing may establish a minimum order value for deliveries, as stated in the Company’s FAQ’s section. The Company reserves the right to decline delivery of orders that do not meet this minimum value.

3.9. Employees of CaterKing are authorised to provide information or make representations about the Goods only if confirmed in writing by the Company. By entering into a contract, the Customer acknowledges that they do not rely on, and waive any claims related to, any representations not formally confirmed in writing by CaterKing.

3.10. The Customer is responsible for ensuring that their order is successfully received by CaterKing. The Company is not liable for any issues arising from the failure to place an order, whether due to communication problems, technical failures, or any other reason.


4. Pricing and Payment

4.1. Prices for Goods will be those indicated on the invoice provided by the Company. CaterKing may change prices and product specifications without prior notice.

4.2. Prices exclude VAT unless specified otherwise. Payment is required either at the time of order or as per the agreed credit terms.

4.3. Accepted payment methods include cash, credit/debit cards, and bank transfers. The Company may impose fees for certain payment methods.

4.4. Late payments may incur interest, and the Company reserves the right to suspend deliveries or place accounts on hold until payment is received.


5. Delivery

5.1. Deliveries will be made according to the Customer’s specified delivery schedule. While CaterKing aims to meet these schedules, the Company is not liable for any delays outside its control.

5.2. It is the Customer’s responsibility to ensure that someone is available to accept the delivery. If paying by cash on delivery, the Customer must have the payment ready upon the driver’s arrival. If cash is not available, the order may be returned, and the Customer’s payment method may be changed to online payment only.

5.3. Customers should inspect and sign for the Goods upon delivery, noting any discrepancies or damages at that time.

5.4. Returns of perishable items such as fresh and frozen goods are not accepted. Non-perishable items may be returned within 14 days, provided they are in their original, unopened packaging and in good condition.


6. Risk and Ownership

6.1. The risk of loss or damage to the Goods passes to the Customer upon delivery. Ownership of the Goods remains with CaterKing until full payment has been received.

6.2. If payment is not made, CaterKing reserves the right to reclaim the Goods from the Customer.


7. Warranties and Liability

7.1. CaterKing guarantees that the Goods will match their descriptions and will be free from defects until their expiration date.

7.2. The Company’s liability is limited to the replacement cost of the Goods and does not extend to indirect or consequential losses. The company warrants that all food goods shall comply with the Food Safety Act 1990 (as amended) and all goods shall comply with all relevant UK and EU legislation.


8. Payment Terms

8.1. For new accounts, payment is required upon delivery unless otherwise agreed. Customers may apply for credit after three months of satisfactory trading with CaterKing.

8.2. Credit account invoices are due for payment on the 15th day of the month following the invoice date. Failure to pay on time may result in the account being placed on hold.

8.3. Dishonoured payments will incur a fee, and any late payments may be subject to interest charges.


9. Online Security

9.1. Customers must keep their account details and passwords secure. The Company is not liable for unauthorized use of a customer’s account as the customer is entirely responsible for the confidentiality of their account password.

9.2. Customer information will not be shared with third parties for marketing purposes without consent.


10. Alcohol Sales

10.1. The purchase of alcohol may require proof of age. Acceptable identification includes a photo driving license, passport, or age verification card.


11. General Terms

11.1. CaterKing expects all interactions with its staff to be respectful. The Company reserves the right to terminate services to any Customer who engages in abusive behaviour.

11.2. Telephone calls may be recorded for training and quality purposes.

11.3. CaterKing may refuse entry to its premises at its discretion and may request identification before releasing an order.

11.4. Parking on CaterKing’s premises is at the Customer’s risk.

11.5. Children must be accompanied by an adult on CaterKing’s premises, and pets are not allowed except for service animals.


12. Governing Law

12.1. These terms and conditions are governed by the laws of the United Kingdom. Any disputes will be resolved under the exclusive jurisdiction of UK courts.
